Terms & conditions
These terms govern the supply of wholesale inventory by MK Trade to business buyers. They are written to set expectations clearly before any purchase, because the liquidation market rewards clarity and punishes assumptions.
Business-to-business only
MK Trade supplies wholesalers, distributors, exporters, retailers, refurbishment businesses and professional resellers. We do not sell to consumers, and orders are accepted on the basis that the buyer is acting in the course of a business. Consumer distance-selling rights do not apply.
Quotes, orders and acceptance
Availability in the liquidation and auction market changes continuously. Any figures, lot references or availability we share are indicative until confirmed in writing. A binding order exists only once we issue a written invoice for a specific lot and the buyer accepts it. Lots are allocated on a first-confirmed basis.
Manifests and product information
Where a manifest or condition report is available, it is provided by the supplying channel and passed to the buyer as received. Manifests describe the expected contents of a lot; they are not a warranty that every listed unit will be present, complete or functional. Where no manifest is available, we will say so before purchase.
Condition, grading and expectations
Stock may originate from customer returns, open-box inventory, warehouse liquidation, overstock, shelf pulls and other secondary-market channels, and may contain mixed conditions. Grading terminology is not standardised across sources. Buyers should assume that sorting, testing and, in some categories, repair form part of the work.
Pricing, payment and title
Prices are quoted per lot in the currency stated on the invoice and exclude freight, duties, import taxes and local clearance charges unless expressly stated. Payment is by bank transfer unless agreed otherwise in writing. Title and risk pass to the buyer on the terms stated on the invoice.
Delivery, freight and export
We can coordinate freight, pallet consolidation and export documentation, or the buyer may arrange collection. Delivery estimates are indicative and depend on the supplying channel and carrier. Import duties, VAT and clearance in the destination market are the responsibility of the buyer.
Claims and discrepancies
Any claim relating to quantity, condition or manifest discrepancy must be raised in writing, with photographs and lot references, promptly after receipt. Remedies depend on the terms of the supplying channel, which are set out before purchase. Claims raised after stock has been sorted, sold or dispersed cannot usually be verified.
Liability
Nothing in these terms limits liability where it cannot lawfully be limited. Otherwise, our liability in respect of any lot is limited to the price paid for that lot, and we are not liable for loss of profit, loss of resale value, loss of opportunity or other indirect or consequential loss.
Changes to these terms
We may update these terms. The version in force is the one published on this page at the time your order is confirmed.
